A Europe of Values 2: Navigating the Rule of Law

As the last decade has proven, being a member state of the European Union does not (always) ensure respect for the rule of law. As heads of governments change (or not) with every election cycle, the EU needed to make sure that all countries respect this common value, as per Article 2 of the Treaty on the European Union. As history shows us, this has not always been the case.

While the new European Rule of Law Mechanism tries to keep an eye on each of the 27 member states, we must ask ourselves whether this will be enough in the long run. And most importantly, whether this mechanism will be strong enough for the more difficult member states such as Hungary, Poland and Slovenia.

The event will take place during the Slovenian Presidency of the Council of the EU, and hence is an opportunity to discuss how the Commission should handle rule of law-related issues in this country: Is there enough for the Commission to trigger Art. 7 as it did for Hungary? Should it withhold EU funds from the Covid Recovery Package?

Moderated by Dr Nuria Gonzalez Campana, Postdoctoral Research fellow in European Constitutional Law at the University of Barcelona

Discussion topics: Rule of Law as a core principle of the EU. How can the European Commission make sure that all current and future member states will respect the Rule of law? Are more penalties needed to ensure the uniform and constant respect of the Rule of law?
